AJs Karting & Lasertag Ltd - Terms & Conditions

1.0 Payment Terms and Conditions
1.1. CONTRACT& VARIATION. The Payment Terms and Conditions form an integral part of every contract in respect of the use of the facilities entered into by AJ'S Karting ("The Company") and The Customer. Unless specific alterations or deletions are expressly agreed in writing on behalf of The Company these conditions shall apply in their entirety. No variation of these terms and conditions shall be binding on The Company unless in writing and signed by a Director of The Company. No relaxation or indulgence which The Company may from time to time extend to the Organiser shall in any way prejudice or act as a waiver of The Company's rights hereunder.
1.2. Receipt of either a deposit or full balance for an event shall constitute a binding contract ("the booking") between the person named on the Booking Form ("the Organiser") and The Company subject to the terms and conditions set out below.
1.3. PRICE. The Company reserves the right to vary any contract price at any time to take account of:
a. Any alterations in the specifications upon which the contract is based.
b. Any variation in the original order made at the request of The Company
c. Any extra cost borne by The Company as a result of any government legislation or EU regulation.
1.4. CONTRACT PRICE. Bookings will only be accepted upon receipt of a deposit, which may be either £10.00 per person,. Bookings made within 7 days of an event may be required to be paid in full.
1.5. Any deposit received is non-transferable and non-refundable.
1.6. Confirmation of booking and the event will remain TENTATIVE until the Deposit payment is received by AJ'S Karting ltd. If The Customer fails to make the above payment then The Company reserves the right to cancel the booking.
1.7. The Organiser is liable for the full race fees for the use of the circuit for number of drivers booked, even if fewer drivers attend.
1.8. Where a cheque is returned unpaid, bank charges of £25.00 and administration charges of £15.00 plus VAT will be levied.
1.9. Interest will be charged on overdue amounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
1.10. CANCELLATION. No contract shall be cancelled by The Customer unless agreed by The Company. Any cancellation shall only be accepted by The Company upon payment of a cancellation fee as follows:
a. More than 28 days prior to the event - Loss of deposit
b. Less than 28 days prior to the event - No refund
c. Race fees will not be refunded to any driver because that driver fails to attend or is withdrawn from the racing for any reason.
The cancellation fee has been calculated to represent a reasonable assessment by The Company of the loss it will suffer as a result of the cancellation.
1.11. All bookings are made subject to availability. Bookings may be considered transferable in extreme circumstances but payments are always non-refundable. The Company does not guarantee the time booked and will not provide any compensation if any event does not take place due to circumstances beyond The Company's control.
1.12. POSTPONEMENT. The Company reserves the right to postpone any event in the case of unforeseen circumstances.
1.13 ABANDONMENT. The Company reserves the right to abandon an event in the case of dangerous track conditions or for any other reason beyond The Company's control.

2.0 Circuit Terms & Conditions
2.1. Motorsport can be dangerous. Due to the very nature of karting there is a certain element of risk for participants and spectators. All persons entering the circuit do so at their own risk. All children under the age of consent must be accompanied by an adult and enter entirely at their own risk.
2.2. Unless written parental consent is presented it is understood that the chaperone take full responsibility for all children under the age of consent in their group and if first aid needs to be administered that they are authorised to give consent. It is also the responsibility of the parent, guardian or chaperone to ensure, AT THE TIME OF BOOKING, that juniors are above the minimum height measurement of 1.3mts. There will be NO REFUND for juniors who fail to meet these requirements.
2.3. Neither the circuit owner or the circuit management nor any other organiser of events at the Circuit shall be liable for any accident, injury or loss howsoever caused to any person, vehicle or property or any claim arising therefrom.
2.4. Spectators watch at their own risk. Children spectating must be kept under close supervision of a responsible adult at all times.
2.5. AJ'S Karting will not be held liable for any accidents, or injuries sustained through involvement in this activity.
2.6. We reserve the right to refuse karting to anyone whom we consider a risk to the safety of themselves or anyone else on the premises.
2.7. The minimum age to participate in events is 8yrs old, with a minimum height of 1.3mtrs.
2.8. The minimum age to participate in adultonly events is 16 yrs old, with a minimum height of 1.55mtrs
2.9. If you are acting on behalf of parents of children that are not your own, by signing the disclaimer you guarantee that the children's' parents are aware that they are participating in a motorsport and are aware of the risks involved.
2.10. Children under the age of 16, regardless of whether they are driving or spectating, must be accompanied by an adult who must remain on the premises for the duration of the child's stay and accept responsibility for them at all times.
2.11. If you are an adult driving with your children, you must respect the fact that the junior driver's safety is our absolute priority. Adult karts may be speed limited for the safety of younger drivers. If you are deemed to be driving in a way that places the junior drivers at risk, then you will be removed from the track at our discretion.
2.12. Proof of age may be asked for to confirm age restrictions above. Any driver who cannot provide suitable proof of age when requested will not be allowed to drive.
2.13. The Circuit reserves the right to remove anyone at any time whose actions are, or could be considered dangerous or detrimental to other participants or the general public. Any damage caused wilfully by any participant will be repaired at the cost of that participant.
2.14. All drivers must attend the race briefing and failure to do so will result in the loss of your drive and any payment already made shall not be refunded.
2.15. For insurance reasons, drivers arriving after the safety briefing has commenced are not allowed to race and will not receive any refund.
2.16. Where an exclusive event is delayed due to late arrivals, the Circuit's management may in their sole discretion and on request of the Organiser delay the safety briefing. In such case, the event will be shortened to make up for the time lost.
2.17.We reserve the right to alter an event and the format if you are late on arrival for your booking

3.0. Force Majeure & Limitation
3.1 Where the event is prevented, frustrated or delayed due to force majeure (including but not limited to riot, strikes, natural catastrophe, adverse weather, power failure, fire, accident or breakdown of plant or machinery) or any other cause beyond its control, the Circuit's liability shall be limited to re-scheduling the event at a future date convenient to all parties.
3.2. The Company shall not be under any liability whatsoever for direct losses, loss of profits, indirect losses or consequential losses of any type caused directly or indirectly by The Company, its sub-contractors, servants, agents or employees (other than liability by Statute that cannot be avoided) and its maximum liability shall in all cases be limited to the total amount paid for the event.
3.3. Notwithstanding the generality of the above, please note that all karting events are live events and may start late or overrun due to unforeseen delays. Any quoted "Start Time" or "End Time" is a pre-event estimate, for guidance only.

4.0 Clothing & Equipment
4.1. You are required to wear the approved safety equipment provided by the circuit which includes, but may not be limited to a race suit, helmet and gloves.
4.2. Junior drivers may be required to wear a neck brace in conjunction with all other safety equipment.
4.3. You may bring/wear your own equipment provided it meets our minimum standards and is approved by a senior member of staff only. If we feel that your gear may not meet our standards you will be required to use our equipment.
4.4. If approved by us, your helmet must be full face and Moto X helmets must be used with goggles at all times.
4.5. Loose clothing, scarves, hoods, valuables, chewing gum and any sharp objects must be removed before changing into our safety equipment for your own safety.
4.6. Long hair must be securely tucked into your suit.
4.7. Where necessary for privacy or religious purposes, you may request a private area for changing.
4.8. Footwear must be trainers or similar. High heels, crocs, open toe, slip on, platform soles and shoes without adequate support are not permitted.

5.0. Alcohol and Drugs
5.1. Drivers must not consume alcohol for at least 12 hours before the event.
5.2. Drivers who are suspected to be under the influence of drugs or alcohol may be prevented from driving at the discretion of the circuit staff, for the safety of themselves and others. You will forfeit any fees paid.

6.0 Medical Restrictions
6.1.Participants must and will not participate in any activity unless I have first attended the drivers briefings where I will be advised and thoroughly informed of the inherent risks in taking part in Karting and related activities, including but not limited to the fact that taking part in Karting and related activities can cause injuries to myself, collisions, overturning, rapid decelerations, rapid accelerations and unpredictable acts and omissions by others.
6.2. I further state that following these briefings, I will abstain from participating should I not agree to accept the inherent risks involved.
6.3. I further state that I am in good physical and mental health, my eyesight (as corrected as appropriate) is up to the standard required for a road driving test and I am not suffering from any other medical condition or disability which might make it unsafe for me to drive.
6.4. I further state that I am not participating against medical advice and that I have not been diagnosed as having a terminal illness which might make it unsafe for me to drive.
6.5.I further declare that in the event of feeling physically or mentally unwell or suffering an injury of any description during the course of Karting activities, I will notify the proprietor of the premises where the activity is taking place or his authorised representative immediately. I will thereafter immediately discontinue any karting activity should I be instructed to do so by the circuit.
6.6. All participants must advise us of any other medical conditions that may be of concern so we can advise you whether it is appropriate for you or others in your group to kart. These include, but are not limited to: heart conditions, back injuries, epilepsy, recurrent blackouts, fainting spells or giddiness amputations/artificial limbs, hearing or sight impairments, or any form of mental or physical impairment.
6.7. I understand that if i exceed of the height/weight limits that the karts are normally designed to cater for,i may not be able to participate. As a general guide drivers above 200cm (6'4") or 114kg (18 stone) should request a private seat fitting prior to your event so that we can assess suitability.
6.8. You may not drive if you are pregnant.

7.0. Behaviour and Adherence to Rules
7.1. You will need to arrive at least 45 minutes before your booking for safety briefing and to change into your suits and safety wear. Any driver arriving after the start of the safety briefing will not be allowed to kart.
7.2. You will listen carefully to the safety briefing that you will be given and abide by the rules and guidelines laid out.
7.3. You understand that AJ'S Karting expects drivers to adhere to its rules to ensure the safety of all drivers, spectators and staff, and that failure to adhere to these rules will result in removal from the premises.
7.4. We reserve the right to end sessions or remove drivers from the circuit early if we consider the safety of themselves or others is compromised.
7.5. We reserve the right to split your group into smaller groups on arrival if we feel that there may be a mixture of abilities or experience that could compromise the safety of any driver.
7.6. You will look after all safety equipment that you use and understand that damages must be paid for.
7.7. Anti-social behaviour on or off the track will not be tolerated and will result in removal from the premises.
7.8. We reserve the right to alter an event and the format if you are late on arrival for your booking.
7.9. I further state that as I'm person organising this group activity I take full responsibility for each and every member of my party and that I have made each one aware of these conditions and will be personally liable for any member of my group that does not comply with them in full.
7.10. Because the driver is the only person in control of the kart the organisers and/or their agents accept no responsibility for any claim whatsoever however this may arise. Any driver deliberately or accidentally causing his or her kart to come into contact with any other kart, person, building or obstacle (not being part of the course) will be stopped immediately and removed from The Circuit.
7.11. The Circuit's management reserve the right to refuse admission and/or to bar drivers from the track for any reason whatsoever in its sole discretion. Any person considered by the Circuit's management to be under the influence of alcohol or medication will not be allowed to race. The Circuit's Management reserve the right to prevent that person from participating or to remove them from The Circuit and any payment already made shall not be refunded. Alcohol is strictly forbidden on the premises. No pets are allowed on the premises.

8.0. Voucher Terms and Conditions
8.1.Vouchers valid until expiry date marked on the voucher - certain restrictions may apply when booking.
8.2. Vouchers are not exchangeable for cash and may not be resold.
8.3. Vouchers cannot be used in conjunction with any other offer incl. Unlimited Karting events.
8.4. Vouchers, and the full voucher number, must be quoted when booking.
8.5.Vouchers must be presented on arrival and must match details provided when booking.
